What the response proposes

Private missions are beginning to reach places where planetary protection is not an abstract concern. Companies are developing missions to search for signs of life at Venus, conduct commercial science at Mars, prospect asteroids, and eventually return material to Earth. Those missions do not all sit inside a NASA program, but they can still raise questions about forward contamination, sample return, the integrity of life-detection science, and the United States' responsibilities under Articles VI and IX of the Outer Space Treaty. The response argues that the Federal Government needs a clear way to address those questions when NASA is the technical expert but not the mission sponsor or licensing agency.

The Society therefore proposes a focused policy study with NASA on planetary protection for independently led American lunar and interplanetary missions. The Society would contribute research on treaty obligations, federal authority, mission authorization, and international governance. NASA would provide the scientific, engineering, contamination-control, and operational grounding. The goal is practical guidance that agencies and mission planners can use early, before uncertainty becomes a late-stage licensing or financing problem.

The first workstream would map the federal mission-authorization interface. NASA already advises the FAA when a commercial mission raises planetary-protection issues, while the Department of Commerce is developing a process for novel missions that do not fit existing regulatory regimes. The study would identify when NASA input is most useful, what should remain scientific or technical guidance, what may need to become a binding condition imposed by the legally responsible agency, and what expectations can be published early enough to support responsible mission design.

The second workstream would test that framework against representative missions: a privately financed life-detection mission, a commercial lunar mission, a commercial Mars surface mission, and a future return of extraterrestrial material. For each case, the study would identify the relevant planetary-protection questions, federal decision points, treaty considerations, and places where current public guidance is either sufficient or unclear. Using concrete mission cases keeps the work tied to decisions agencies and operators are likely to face.

The third workstream would examine international policy and COSPAR. Because COSPAR's planetary-protection policy is a voluntary standard, national authorities remain responsible for implementation. The response proposes studying how NASA, working with the Department of State and other agencies, can carry American operational experience into international practice and help planetary-protection policy evolve alongside commercial missions and sustained human exploration. An initial collaboration would produce a focused policy study of current roles, consultation points, gaps in public guidance, and recommendations for federal and international practice.
