No Constitution for Space

The Outer Space Treaty is commonly read as the constitution of outer space, an incomplete foundation waiting to be built upon. This paper argues that the reading fails at the foundation itself. The treaty produced working machinery for the traffic of space while leaving its principles deliberately vague. The Moon Agreement is the proof. When the developing world tried to give that language binding form, the treaty's own drafters refused it.
